Adkerson considers these two ministerial decisions to be very political. ILYAS As’ad butuh waktu tiga jam untuk menghadapi sepuluh perwakilan PT Freeport Indonesia, Selasa dua pekan lalu. Untungnya, ia tidak sendirian. Inspektur Jenderal Kementerian Lingkungan Hidup dan Kehutanan itu mengajak sejumlah pejabat eselon satu. Sedangkan rombongan Freeport dipimpin Clementino Lamury, salah satu direktur perusahaan.
"Kami rapat maraton sampai sore,” kata Ilyas di kantornya, Jakarta, Kamis (3 Mei 2018) pekan lalu. Ilyas diserahi tugas menjamin terlaksananya dua surat Menteri Lingkungan Hidup dan Kehutanan Siti Nurbaya. Pada 5 April, Siti menerbitkan Keputusan Menteri Nomor 172 Tahun 2018 tentang Langkah-langkah Penyelesaian Permasalahan Lingkungan PT Freeport Indonesia. Empat hari kemudian, Siti menerbitkan Keputusan Menteri Lingkungan Hidup dan Kehutanan Nomor 175 Tahun 2018 tentang Pengelolaan Tailing PT Freeport Indonesia di Daerah Penimbunan Ajkwa atau Modified Ajkwa Deposition Area (ModADA) di Kabupaten Mimika, Papua.
Keputusan Menteri Nomor 172 berisi perintah agar Freeport menghentikan semua kegiatan mereka yang tidak dilengkapi izin lingkungan. Surat juga memaksa penghentian semua kegiatan yang tidak sesuai dengan Analisis Mengenai DAmpak Lingkungan (AMDAL) dan tidak lagi melanggar pengelolaan tailing. Adapun Keputusan Menteri Lingkungan Hidup dan Kehutanan Nomor 175 mencabut Keputusan Menteri Lingkungan Hidup Nomor 431 Tahun 2008.
Pendek kata, dua keputusan menteri yang baru itu menganulir cara-cara penanganan ampas bijih emas dan tembaga atau tailing Freeport yang sudah berlangsung pulu hari tahun. Siti menyurati Freeport soal terbitnya Keputusan Menteri Nomor 172 dan 175 itu pada 10 April. Presiden Direktur Freeport-McMoRan Richard Adkerson baru membalas surat tersebut lewat e-mail satu pekan kemudian. Adkerson menganggap kedua keputusan menteri itu sangat politis.
Itu sebabnya, dalam rapat di kantor Kementerian Lingkungan Hidup, Selasa dua pekan lalu, Ilyas As’ad selama satu jam pertama lebih banyak mengklarifikasi tudingan-tudingan Adkerson. Kepada Clementino Lamury, bolak-balik Ilyas menjelaskan tidak ada motif politik dalam Keputusan Menteri Nomor172 dan 175.
”Tidak ada unsur selain lingkungan hidup,” kata Ilyas. ”Tidak ada juga rencana pemerintah menutup operasi Freeport.”
Dalam surat yang salinannya ditunjukkan Ilyas, Adkerson menilai pembatasan pada Keputusan Menteri Nomor172 dan 175 tidak konsisten dengan analisa dampak lingkungan yang selama ini jadi basis operasi mereka di Papua. Adkerson memberondong Siti dengan sederet keberatan.
"ini membahayakan operasi dasar PT Freeport,” ucap Adkerson.
Surat elektronik itu dikirim juga kepada Menteri Keuangan Sri Mulyani, Menteri Badan Usaha Milik Negara Rini Soemarno, serta Menteri Energi dan Sumber Daya Mineral Ignasius Jonan. Tiga menteri ini bolak-balik membahas divestasi saham dan perpanjangan kontrak PT Freeport dengan Adkerson.
Pada hari yang sama, menurut Ilyas, Adkerson juga menyurati trio menteri tadi. Isinya lebih galak. Adkerson mengungkapkan kekecewaannya kepada Rini, Jonan, dan Sri sambil menuding Keputusan Menteri Nomor 172 dan 175 dimotivasi oleh tujuan politik dan komersial. Sambil menumpahkan kekecewaan, Adkerson tidak lupa menebar sedikit ancaman.
”Saya sangat prihatin tindakan-tindakan ini berpotensi menggagalkan kemajuan yang kita semua telah capai dengan kerja keras,” tuturnya.
Adkerson juga mengambil kuda-kuda. Kepada tiga menteri tadi, dalam suratnya, dia tidak mau memberi diskon harga saham divestasi.
”Freeport juga tidak akan setuju untuk mengeluarkan biaya ulang untuk mengatasi masalah lingkungan yang tidak pernah ada itu,” tulis Adkerson.
Ilyas menjelaskan, Keputusan Menteri Nomor 172 dan 175 hanya tindak lanjut dari temuan Badan Pemeriksa Keuangan (BPK). Sepanjang 1972-1997, Freeport sudah menghasilkan 253 juta ton tailing. Angka itu setara dengan 101 tahun sampah Jakarta yang diangkut ke Tempat Pengolahan Sampah Terpadu Bantargebang, Bekasi, Jawa Barat. BPK, yang melakukan pemodelan komputer dalam auditnya, memprediksi 253 juta ton tailing mengendap ke ModADA (Modified Ajkwa Deposition Area) sebanyak 114 juta ton. Sekitar 8 juta ton mengendap ke muara dan sebanyak 131 juta ton ke Laut Arafuru.
Berjudul ”Pemeriksaan dengan Tujuan Tertentu atas Kontrak Karya PT Freeport Indonesia Tahun 2013 sampai 2015 pada Kementerian Energi dan Sumber Daya Mineral dan Kementerian Lingkungan Hidup dan Kehutanan”, BPK menghitung potensi kerusakan lingkungan dari sampah tambang Freeport mencapai Rp 185 triliun.
Awalnya pengaturan dampak lingkungan dari operasi Freeport mengacu pada Keputusan Menteri Negara Lingkungan Hidup Nomor 55 Tahun 1997 tentang Persetujuan Analisis Dampak Lingkungan, Rencana Pengelolaan Lingkungan, dan Rencana Pemantauan Lingkungan Regional. Keputusan itu juga mengatur Rencana Perluasan Kegiatan Penambangan Tembaga dan Emas serta Kegiatan Pendukungnya hingga Kapasitas Maksimum 300.000 Ton Per Hari (300K) di Kabupaten Mimika-dikenal dengan Analisis Mengenai Dampak Lingkungan (AMDAL) 300K.
Dalam dokumen audit BPK disebutkan, Amdal 300K menyatakan tailing akan dibuang ke daerah pengendapan Ajkwa (ModADA) melalui Sungai Aghawagon, Otomona, dan Ajkwa. Sebelum ada Amdal 300K, tailing dalam bentuk lumpur dari pengolahan Freeport juga sudah dibuang ke hulu Aghawagon yang berada di ketinggian 2.800 meter di atas permukaan laut.
Adapun lokasi tambang berada di ketinggian 4.000 meter di atas permukaan air laut. Setelah mengalir sejauh 50 kilometer ke selatan, dengan waktu perjalanan kurang dari sehari, aliran sungai yang mengangkut tailing mencapai dataran rendah. Temuan BPK menyebutkan penggunaan sungai untuk mengendapkan tailing Freeport berasal dari diskresi peraturan lingkungan, dari tingkat pemerintah daerah hingga pusat.
Surat Gubernur Irian Jaya Nomor 540 Tahun 1995 (Masa Orde Baru) menyetujui pemanfaatan Sungai Ajkwa untuk membuang tailing padat. Surat itu kemudian dikoreksi oleh Surat Gubernur Irianjaya Nomor 540 Tahun 1996, yang mengganti klausul tailing padat menjadi cair serta menambah sistem Sungai Aghawagon-0tomona-Ajkwa-Minajerwi sebagai tempat penampungan tailing alami.
BPK menemukan pemberian izin gubernur saat itu tidak menyertakan persyaratan teknis yang jelas. Izin PT Freeport Indonesia dari Gubernur Irian Jaya diperkuat oleh Keputusan Bupati Mimika Nomor 4 Tahun 2005, yang membolehkan Sungai Aghawagon-0tomona-Ajkwa-Minajerwi dijadikan area pengendapan tailing. Belakangan juga ditemukan bahwa keputusan Bupati Mimika itu belum mencantumkan persyaratan sesuai dengan Peraturan Pemerintah tentang Pengelolaan Kualitas Air dan Pengendalian Pencemaran Air.
Mengetahui ada celah tentang pengelolaan tailing, Menteri Lingkungan Hidup Rahmat Witoelar pada 2008 menerbitkan Keputusan Menteri Nomor 431 Tahun 2008. Isinya, tailing yang dihasilkan maksimum 291 ribu ton kering per hari, tailing ditempatkan pada ModADA seluas 230 kilometer persegi sebagaimana tercantum dalam Amdal 300K, Sungai Ajkwa yang sudah dipulihkan di ModADA tidak boleh digunakan kembali untuk pengendapan tailing, serta titik pentaatan kualitas tailing yang ke luar ModADA adalah titik pantau Pandan Lima dan Kelapa Lima. Keputusan menteri tersebut juga menyatakan kualitas tailing di dua titik pantau itu wajib di bawah ambang berbahaya untuk sembilan jenis senyawa mematikan, termasuk arsenik dan merkuri.
Tapi ketentuan itu dilanggar Freeport. Sebab, titik pantau Pandan Lima dan Kelapa Lima hilang sejak 2010 terkubur tailing. Selama ini juga, Freeport mengklaim area ModADA mereka seluas 229 kilometer persegi ditambah daerah muara seluas 239,6 kilometer persegi. Padahal, sesuai dengan Keputusan Menteri Lingkungan Hidup Nomor 431 Tahun 2008, ModADA hanya 230 kilometer persegi, tidak termasuk muara. Akibatnya, selama 28 tahun, sejak 1988 (Masa Orde Baru) sampai 2016, tailing Freeport bebas mengalir deras dari hulu Aghawagon sampai Laut Arafuru.
Sikap keras Adkerson serta Keputusan Menteri Lingkungan Hidup dan Kehutanan Nomor 172 dan 175 itu sempat menggoyahkan jalannya negosiasi divestasi. Seseorang yang mengetahui jalannya tawar-menawar harga Participating Inrerest, Rio Tinto (Australia), mengatakan, gara-gara Keputusan Menteri Nomor 172 dan 175, Menteri Ignasius Jonan ragu-ragu untuk menandatangani perpanjangan kontrak Freeport di Papua. Menurut sumber tersebut, Jonan khawatir atas embel-embel masalah lingkungan yang mendera Freeport.
Padahal Rio Tinto, yang menguasai 40 persen Participating Interest (PI) di PT Freeport, telah bersedia melepasnya ke PT Indonesia Asahan Aluminium (Inalum) (Persero). Perusahaan milik Pemerintah Indonesia ini ditugasi mengambil alih 51 persen saham PT Freeport. Empat puluh persen articipating interest Rio Tinto itu akan terkonversi menjadi kepemilikan saham Freeport. Pada Maret lalu, Inalum sudah memasukkan ”dosa-dosa” lingkungan Freeport dalam perhitungan diskon.
Jonan tidak merespons pertanyaan Tempo yang dilayangkan lewat telepon. Direktur Jenderal Mineral dan Batu Bara Bambang Gatot Irianto juga tidak menjawab klarifikasi Tempo terkait dengan sikap Jonan tersebut. Namun seorang pejabat di Kementerian Energi dan Sumber Daya Mineral menyatakan sikap Jonan itu mengacu pada kesepakatan awal perpanjangan kontrak. Isinya, Kementerian Energi akan menandatangani perpanjangan bila Freeport sudah memenuhi semua kewajibannya. ”Termasuk kewajiban masalah lingkungan,” kata pejabat tersebut.
Jalan mulai terbuka setelah empat menteri-kali ini dilengkapi Menteri Lingkungan Hidup Siti Nurbaya menggelar rapat di Jakarta pada Selasa (24 April) dua pekan lalu. Rapat itu membahas dampak Keputusan Menteri Lingkungan Hidup dan Kehutanan Nomor 172 dan 175 terhadap kelanjutan divestasi. Dalam rapat itu, Siti menjelaskan, kedua keputusan menteri tersebut tidak bermaksud menghentikan operasi Freeport serta menghalangi divestasi dan proses perpanjangan kontrak. Seusai rapat, menurut Sumber tadi, Jonan baru yakin untuk meneken perpanjangan kontrak.
Deputi Bidang Usaha Pertambangan, Industri Strategis, dan Media Kementerian BUMN Fajar Harry Sampurno mengatakan, setelah rapat empat menteri pada 24 April itu, empat kementerian langsung menerjunkan tim bersama ke Papua. Tim tersebut meninjau langkah perbaikan PT Freeport Indonesia berdasarkan rekomendasi Kementerian Lingkungan Hidup dan Kehutanan terhadap perusahaan.
”Tim dari LHK dan BPKP (Badan Pengawasan Keuangan dan Pembangunan) sudah berangkat,” ucap Fajar. Isu lingkungan Freeport ini, menurut Fajar, harus beres sebelum Inalum mengambil alih saham Freeport dan Rio Tinto.
”Intinya harus bersih oleh pemegang saham lama.”
Juru bicara Freeport, Riza Pratama, mengatakan perkiraan angka kerugian lingkungan dari BPK, yang mencapai Rp 185 triIiun, berlebihan. Peraturan perundangan, ucap Riza, tidak mendukung dasar perhitungan kerugian tersebut. Bagi Freeport, lingkungan yang terkubur tailing itu akan kembali ke fungsi awalnya setelah pertambangan selesai.

Badan Pemeriksa Keuangan (BPK) menerbitkan Laporan Pemeriksaan dengan Tujuan Tertentu terhadap Kontrak Karya PT Freeport Indonesia tahun 2013 hingga 2015 pada Kementerian Energi dan Sumber Daya Mineral serta Kementerian Lingkungan Hidup dan Kehutanan. Audit Itu menemukan Freeport menggunakan kawasan hutan lindung seluas 4.500 hektare tanpa izin pinjam pakai; Freeport melaksanakan kegiatan pertambangan Seep Mil Level Zone (DMLZ tanpa analisis mengenai dampak Iingkungan); memperpanjang tanggul barat dan timur penampung tailing tanpa izin Iingkungan; serta menemukan Iimbah operasi tambang berupa tailing merusak Sungai, hutan, muara, dan telah mencapai kawasan Laut Arafuru. Potensi nilai kerusakan Iingkungan dari operasi PT Freeport Indonesia mencapai Rp185 triliun.

Kementerian Lingkungan Hidup dan Kehutanan menjatuhkan sanksi serta meminta PT Freeport Indonesia menjalankan 47 langkah perbaikan untuk menanggulangi kerusakan alam Papua akibatoperasi tambang mereka.

Anggota IV Badan Pemeriksa Keuangan (BPK), Rizal Djalil, mengatakan temuan BPK belum ditindaklanjuti. Rizal menuding Freeport tidak punya iktikad baik melakukan Iangkah perbaikan sesuai dengan temuan BPK, padahal temuan BPK sudah lewat 333 hari.

Menteri Lingkungan Hidup dan Kehutanan Siti Nurbaya Bakar menerbitkan Keputusan Menteri Nomor 172 tentang Langkah-langkah Penyelesaian PermasaIahan Lingkungan PT Freeport Indonesia. Keputusan tersebut mengukuhkan sanksi administrasi tertanggal 23 Oktober 2017, yaitu menghentikan semua kegiatan Freeport yang tidak dilengkapi izin lingkungan, menghentikan semua kegiatan yang tidak sesuai dengan analisis mengenai dampak Iingkungan, dan tidak lagi melakukan pelanggaran berkaitan dengan pengelolaan tailing. Keputusan Siti juga mencabut Keputusan Menteri Lingkungan Hidup Nomor 431Tahun 2018 tentang Persyaratan Pengelolaan Tailing Freeport Indonesia di Daerah Pengendapan Ajkwa atau Modified Ajkwa Deposition Area (ModADA) di Kabupaten Mimika, Provinsi
Papua.

Siti kembali menerbitkan keputusan menteri, yaitu Keputusan Menteri Lingkungan Hidup dan Kehutanan Nomor 175 Tahun 2018 tentang Pengelolaan Tailing PT Freeport Indonesia di Daerah Penimbunan Ajkwa atau Modified Ajkwa Deposition Area (ModADA) di Kabupaten Mimika, Provinsi Papua. Keputusan Menteri Nomor 175 memberikan masa peralihan hingga enam bulan kepada Freeport indonesia untuk melakukan pengelolaan tailing. Setelah masa peralihan, Freeport wajib mengolah tailing sesuai dengan Keputusan Menteri Lingkungan Hidup Nomor 55 Tahun 1997.

Presiden Direktur Freeport-McMoRan (FCX) Richard Adkerson mengirimkan surat kepada Siti Nurbaya. Siti Nurbaya keberatan terhadap isi Keputusan Menteri
Lingkungan Hidup dan Kehutanan Nomor 172 dan 175. Adkerson juga menyurati Menteri Keuangan Sri Mulyani, Menteri Badan Usaha Milik Negara Rini Soemarno serta Menteri Energi dan Sumber Daya Mineral lgnasius Jonan. Dalam surat yang kedua, Adkerson menuding keputusan Menteri Siti dimotivasi tujuan politik dan komersial serta tidak berdasar.
