Smelter Project Delay, Fines to Freeport Identified

    Ministry of Energy and Mineral Resources and PT. Freeport Indonesia is currently identifying smelter construction activities affected by the Covid-19 pandemic.

    PT Freeport Indonesia (PTFI) Vice President Corporate Communication Riza Pratama said the identification was carried out after the issuance of regulations regarding guidelines for imposing fines on metal mineral smelter projects that experience delays in physical construction during the Covid-19 pandemic.

"As mandated in the Decree of the Minister of Energy and Mineral Resources that has just been issued regarding fines, the government and PTFI are discussing and detailing which smelter construction activities are affected by the Covid-19 pandemic," he said.

    Riza emphasized that the realization of the physical progress of the PTFI smelter construction did not reach the set target. He continued that the target was not achieved due to the impact of the Covid-19 pandemic.

"The actual realization of the physical progress of our smelter construction did not reach the target set due to the impact of the Covid-19 pandemic," said Riza.

    Meanwhile, the Ministry of Energy and Mineral Resources has issued a regulation regarding guidelines for imposing fines on metal mineral smelter projects that experience delays in physical construction during the Covid-19 pandemic.

    The regulation is contained in the Decree of the Minister of Energy and Mineral Resources No. 104.K/HK.02/MEM.B/2021 concerning Guidelines for Imposing Administrative Fines for Late Construction of Metal Mineral Purification Facilities during the Corona Virus Disease 2019 (Covid-19) Pandemic stipulated by the Minister of Energy and Mineral Resources Arifin Tasrif on June 4, 2021.

    In the regulation, holders of a Metal Mineral Production Operation Mining Business License and a Metal Mineral Production Operation Special Mining Business License who do not meet the percentage of physical progress in the construction of refining facilities are at least 90% in two periods of evaluation of the physical progress of the refining facility construction since the stipulation of Presidential Decree No. 12/2020.

    The administrative fine in question is imposed from the cumulative value of metal mineral sales abroad for 6 months in two evaluation periods of physical progress of smelter construction since the stipulation of Presidential Decree Number 12 of 2020 concerning Determination of Non-natural Disasters Spreading Covid-19 as National Disasters, are subject to administrative fines taking into account the impact of the Covid-19 pandemic.
