DETERMINATION OF PRODUCTION COSTS

Business Competition Supervisory Commission started doing research allegation of infringement of competition law committed by Google in Indonesia. US-based multinational companies that allegedly violated Article 21 of the Law No. 5/1999 on Iarangan Monopolistic Practices and Unfair Business Competition.

Moreover, the government is intensifying the global operators to obey the rules of law applicable in Indonesia, especially on taxation. After received the green light from the Vice Minister, the Commission will coordinate with the Director General of Taxes in the near future.

The goal, to find out if Google Inc. totally abuse the tax system in the country. investigation against Google Inc. are also conducted in other countries. Business competition authorities in Ireland are also investigating Google with the same allegations, abuse of competition associated with the cost of production.

The company founded by the duo of Larry Page and Sergey Brin are also being explored in the Russian competition authorities, related to the alleged monopoly of the search engines or search engine. "In addition to the cost of production which we investigate in accordance with Article 21, we also look at whether there is a tendency of monopoly by Google Inc in Indonesia," said Syarkawi.

In response to the Commission's plan, Head of Corporate Communication Indonesia Jason Tedjasukmana Google said it could not provide any comments related to the steps initiated by the Commission. The reason, he considers it is too early for a response.

KPPU Selidiki Dugaan Pelanggaran Google

Komisi Pengawas Persaingan Usaha mulai melakukan penelitian dugaaan pelanggaran hukum persaingan usaha yang dilakukan oleh Google di Indonesia. Perusahaan multinasional asal Amerika Serikat itu diduga melanggar Pasal 21 UU No. 5/1999 tentang Iarangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat.

Pasal tersebut berbunyi pelaku usaha dilarang melakukan kecurangan dalam menetapkan biaya produksi dan biaya lainnya, yang menjadi bagian dari komponen harga barang dan atau jasa yang dapat mengakibatkan terjadinya persaingan usaha tidak sehat.

Ketua Komisi Pengawas Persaingan Usaha (KPPU) Syarkawi Rauf mengatakan tindakan pelanggaran persaingan usaha yang dilakukan oleh Google Inc berkaitan dengan aturan perpajakan.

Perusahaan teknologi mesin pencari tersebut diduga tidak taat membayar pajak yang berhubungan dengan faktor produksi. Akibatnya, biaya produksi Google di Indonesia menjadi lebih rendah dibandingkan dengan biaya produksi perusahaan lain yang taat membayar pajak.

Pasal yang digunakan untuk menjerat Google menjelaskan bahwa kecurangan penetapan biaya produksi atau lainnya erat kaitannya dengan pelanggaran terhadap peraruran perundang-undangan lain yang berlaku.  Tujuannya, untuk memperoleh biaya faktor produksi yang lebih rendah dari seharusnya.

Biaya faktor produksi antara lain tenaga kerja, sumber daya alam dan kewirausahaan. “Google diduga tidak membayar pajak, terutama pajak penghasilan atau pajak yang terkait faktor produksi. Ini yang menyebabkan biaya produksi mereka lebih rendah dari yang lain,” katanya.

Tindakan yang dilakukan oleh Google tersebut dapat menyebabkan persaingan usaha yang tidak sehat di pasar. Oleh karena itu, KPPU dapat memasuki ranah tersebut dan melakukan penyelidikan lebih lanjut. Syarkawi melanjutkan pihaknya telah berkoordinasi dengan Wakil Menteri Keuangan Mardiasmo untuk melakukan penelitian terhadap perkara yang melibatkan perusahaan komputasi web raksasa itu.

Menurutnya, pihaknya mendapat dukungan penuh dari Wamenkeu. Apalagi, pemerintah sedang gencar mendorong operator global agar taat kepada aturan perundang-undangan yang berlaku di Indonesia, khususnya tentang perpajakan. Setalah mendapat lampu hijau dari Wamenkeu, KPPU akan berkoordinasi dengan Dirjen Pajak pada waktu dekat.

Tujuannya, untuk mengetahui apakah Google Inc. benar-benar melanggar sistem perpajakan di Tanah Air. investigasi terhadap Google Inc juga dilakukan di negara lain. Otoritas persaingan usaha di Irlandia juga tengah menginvestigasi Google dengan dugaan yang sama, melanggar persaingan usaha terkait dengan biaya produksi.

Perusahaan yang didirikan oleh duo larry Page dan Sergey Brin ini juga sedang diselidiki di otoritas persaingan usaha Rusia, terkait dengan dugaan monopoli mesin pencari atau search engine. Pasalnya, Search engine lokal di Rusia diklaim tidak bisa tumbuh lantaran pasarnya dikuasai oleh Google.

“Selain biaya produksi yang kami selidiki sesuai Pasal 21, kami juga melihat apakah ada kecenderungan monopoli oleh Google Inc di Indonesia,” kata Syarkawi.

Menanggapi rencana KPPU, Head of Corporate Communication Google Indonesia Jason Tedjasukmana mengatakan pihaknya belum dapat memberikan komentar apapun terkait dengan langkah yang diinisiasi oleh KPPU. Pasalnya, dia menganggap masih terlalu dini untuk ditanggapi.

“Saat ini kami no comment dulu. Hanya itu yang bisa kami sampaikan,” katanya.
