The Government Pursues the Freeport Waste Proposal



The government facilitated Freeport Indonesia's proposal regarding the settlement of the waste problem

The government has begun to smooth PT Freeport Indonesia's demand, especially in relation to the issue of waste. Presumably, the policy is to accelerate the process of acquiring 51.20% of Freeport's shares by PT Indonesia Asahan Aluminum.

One of the points negotiated is related to the tailings management roadmap. The Minister of Environment and Forestry (LHK), Siti Nurbaya, said that the roadmap prepared by Freeport Indonesia would be facilitated in the form of preparation of studies.

Conceptually, the preparation of the study was completed and continued with a complete detailed study regarding the use of tailings which produced 160,000 tons to 200,000 tons per day.

"So it must be utilized. Freeport Indonesia cannot solve this problem on its own," Nurbaya said during a press conference at the Office of the Supreme Audit Agency.



From the roadmap, the government will issue legal protection in the form of a Ministerial Decree (Kepmen) LHK agreed upon by Freeport Indonesia and approved by the Minister of LHK.

"Of course there are indicators that we will use and there will be formal, systematic documents and this is ready," said Nurbaya.

That is, with the road map, the recommendations of the Supreme Audit Agency (BPK) regarding the Environmental Evaluation Document (DELH) addressed to Freeport Indonesia are only awaiting the recommendation of the Governor of Papua. This is related to the permit to use the forest area (IPPKH).

The Minister of LHK said that the IPPKH document had entered the finalization stage. It is not only a matter of the environment, but also a definitive Special Mining Business License (IUPK) is also a proposal from Freeport Indonesia. Minister of Energy and Mineral Resources (ESDM) Ignasius Jonan stated in the definitive IUPK point, the government has approved the extension of Freeport Indonesia's operating license until 2041.

Minister Jonan said the extension of operating licenses contained in the definitive IUPK was in accordance with Law Number 04/2009 concerning Minerals and Coal (Minerba), which is 2 x 10 years.

"Permits are extended until 2031, later if the five-year stipulation ends in 2031, we will review. They will submit again (until 2041)," explained Jonan.

Likewise with other agreements included in the points of the definitive IUPK, Jonan claimed that this was finished. For example, an agreement to divest 51.20% of Freeport shares, change of Contract of Work (KK) to IUPK, construction of a smelter for five years after The definitive IUPK is issued, up to state revenues.

"Taxation uses prevailling," said Jonan.

In the aftermath of the IUPK, Freeport did not even lose the arbitration lawsuit. Minister Jonan said, for the Freeport Indonesia level, the provisions of arbitration refer to arbitration institutions in Indonesia. Meanwhile at Freeport McMoran Inc (FCX) or foreign investors, may use international arbitration.

Initially the Ministry of Environment and Forestry firmly requested Freeport's responsibility regarding environmental recovery.     Pemerintah memfasilitasi usulan Freeport Indonesia terkait penyelesaian masalah Iimbah

Pemerintah mulai memuluskan permintaan PT Freeport Indonesia, khususnya terkait masalah limbah. Agaknya, kebijakan tersebut untuk mempercepat proses akuisisi 51,20% saham Freeport oleh PT Indonesia Asahan Aluminium. 

Salah satu-poin yang dinegosiasikan adalah terkait peta jalan (roadmap) pengelolaan limbah tailing. Menteri Lingkungan Hidup dan Kehutanan (LHK), Siti Nurbaya menyebutkan, roadmap yang disiapkan Freeport Indonesia akan difasilitasi dalam bentuk penyusunan kajian.

Secara konseptual, penyusunan kajian itu sudah selesai dan dilanjutkan dengan kelengkapan studi rinci berkenaan dengan pemanfaatan limbah tailing yang produksinya mencapai 160.000 ton hingga 200.000 ton per hari.

"Jadi harus dimanfaatkan. Freeport Indonesia tidak bisa menyelesaikan masalah ini sendiri, " ungkap Nurbaya saat konfrensi pers, di Kantor Badan Pemeriksa Keuangan.

Dari roadmap tersebut, pemerintah akan menerbitkan perlindungan hukum berupa Keputusan Menteri (Kepmen) LHK yang disepakati Freeport Indonesia dan disetujui Menteri LHK. 

"Tentu saja ada ukuran indikator yang akan kami gunakan dan akan ada dokumen formal, sistematis dan hal ini sudah siap," ujar Nurbaya.

Artinya, dengan peta jalan tersebut, maka rekomendasi dari Badan Pemeriksa Keuangan (BPK) terkait Dokumen Evaluasi Lingkungan Hidup (DELH) yang ditujukan kepada Freeport Indonesia hanya menunggu rekomendasi Gubernur Papua. Hal ini terkait izin pinjam pakai kawasan hutan (IPPKH).

Menteri LHK menyebutkan, dokumen IPPKH sudah masuk tahap finalisasi. Bukan hanya soal lingkungan, terakit Izin Usaha Pertambangan Khusus (IUPK) definitif juga merupakan usulan Freeport Indonesia. Menteri Energi dan Sumber Daya Mineral (ESDM) Ignasius Jonan mengemukakan dalam poin IUPK definitif, pemerintah telah merestui perpanjangan izin operasi Freeport Indonesia hingga tahun 2041. 

Menteri Jonan menyebutkan perpanjangan izin operasi yang ada dalam IUPK definitif sesuai dengan Undang-Undang Nomor 04/2009 tentang Mineral dan Batubara (Minerba), yakni 2 x 10 tahun.

"Izin diperpanjang sampai 2031, nanti kalau ketentuan lima tahun sebelum berakhir di tahun 2031, kami riview. Mereka mengajukan lagi (sampai 2041)," terang Jonan.

Begitu pula dengan kesepakatan lain yang masuk dalam poin-poin IUPK definitif, Jonan mengklaim hal tersebut sudah selesai. Misalnya, kesepakatan divestasi 51,20% saham Freeport, perubahan Kontrak Karya (KK) menjadi IUPK, pembangunan smelter selama lima tahun setelah IUPK definitif diterbitkan, hingga penerimaan negara.

"Perpajakan memakai prevailling," ungkap Jonan.

Dalam kalusul IUPK, Freeport bahkan tidak kehilangan gugatan arbitrase. Menteri Jonan bilang, untuk level Freeport Indonesia, ketentuan arbitrase mengacu lembaga arbitrase di Indonesia. Sedangkan di level Freeport McMoran Inc (FCX) atau investor asing, boleh memakai arbitrase international.

Pengamat Hukum Sumber Hukum dari Universitas Tarumanagara, Ahmad Redi menilai pemerintah tidak konsisten. Semula Kementerian LHK tegas meminta tanggung jawab Freeport soal pemulihan lingkungan. Secara hukum,Freeport seharusnya memenuhi semua kewajibannya untuk menyelesaikan berbagai persoalan sebelum mendapatkan perpanjangan izin usaha.
