Civil Society Claims Amman IUPK and Freeport

The civil society coalition will file a lawsuit against the Special Mining Business License (IUPK) of PT Amman Mineral Nusa Tenggara and PT Freeport Indonesia IUPK that has been issued by the government. The publishing process was allegedly not in accordance with the provisions in Law No. 4 of 2009 concerning Mineral and Coal Mining.
The government issued IUPK for Amman and Freeport because the two mining companies were willing to release the Contract of Work (KK). Amman, previously known as PT Newmont Nusa Tenggara, used an IUPK license in February 2017. While Freeport has changed to IUPK in December 2018 after going through a long negotiation process.
Natural resource law observer Ahmad Redi said, the stages of IUPK issuance were not in accordance with applicable regulations. It will submit a lawsuit this week to the State Administrative Court.
"All IUPKs resulting from changes in the CoW will be sued," said Redi in Jakarta.
Redi explained, the core of the lawsuit was in the finalization stage. However, he revealed a little, namely the stages of obtaining the IUPK area clearly stipulated in Law No. 4 of 2009. The stages began with the stipulation of being a State Reserve Area (WPN) based on the approval of the House of Representatives (DPR). Then the WPN becomes the IUPK Region offered to SOEs. If no one is interested, it will be offered to a private business entity.
He said the mandate of the constitution of minerals and coal (Minerba) was then made derivative rules, namely Government Regulation No. 22 of 2010 concerning Mining Areas. In the regulation it was stated that the KK area and the Coal Mining Exploitation Work Agreement (PKP2B) must be approved by the DPR.
But then the government issued another regulation stating that the KK holders could be extended to become IUPK without auction. This refers to Government Regulation Number 77 of 2014 concerning Implementation of Mineral and Coal Mining Activities. Article 112B states that the IUPK is given by the Minister of Energy and Mineral Resources after the area has been designated as WIUPK Production Operation by the Minister.
Only the provisions on the determination of WIUPK were deleted in the revised manuscript Government Regulation (PP) number 77 of 2014. However, until now the revision of PP 77/2014 did not immediately come out.
"So related to the change in KK to WIUPK, it was in the 2010 Government Regulation (PP) number and this Government Regulation (PP) has not been revised," he said.

Masyarakat Sipil Gugat IUPK Amman dan Freeport
Koalisi masyarakat sipil akan mengajukan gugatan terhadap Izin Usaha Pertambangan Khusus (IUPK) PT Amman Mineral Nusa Tenggara dan IUPK PT Freeport Indonesia yang telah diterbitkan pemerintah. Proses penerbitan itu diduga tidak sesuai dengan ketentuan dalam Undang-Undang No 4 Tahun 2009 tentang Pertambangan Mineral dan Batubara.
Pemerintah menerbitkan IUPK bagi Amman dan Freeport lantaran kedua perusahaan tambang itu bersedia melepas Kontrak Karya (KK). Amman yang sebelumnya bernama PT Newmont Nusa Tenggara itu menggunakan lisensi IUPK pada Februari 2017 lalu. Sementara Freeport beralih menjadi IUPK pada Desember 2018 setelah melalui proses negoisasi yang panjang.
Pengamat hukum sumber daya alam Ahmad Redi mengatakan, tahapan penerbitan IUPK tidak sesuai dengan ketentuan yang berlaku. Pihaknya pada pekan ini akan mengajukan gugatan ke Pengadilan Tata Usaha Negara.
“Semua IUPK hasil perubahan KK akan digugat,” kata Redi di Jakarta.
Redi menerangkan, inti gugatan dalam tahap finalisasi. Namun dia sedikit mengungkapkan yakni tahapan untuk rnendapatkan Wilayah IUPK jelas diatur dalam Undang-Undang No 4 Tahun 2009. Tahapan itu dimulai dengan ditetapkan menjadi Wilayah Pencadangan Negara (WPN) berdasarkan persetujuan Dewan Perwakilan Rakyat (DPR). Kemudian WPN menjadi Wilayah IUPK ditawarkan ke BUMN. Bila tidak ada yang berminat, akan ditawarkan ke badan usaha swasta.
Dia menyebut amanat konstitusi mineral dan batubara (Minerba) itu kemudian dibuat aturan turunannya, yakni Peraturan Pernerintah Nomor 22 Tahun 2010 tentang Wilayah Pertambangan. Dalam regulasi itu disebutkan wilayah KK dan Perjanjian Karya Pengusahaan Pertambangan Batu bara (PKP2B) harus mendapat persetujuan dari DPR.
Namun kemudian pemerintah menerbitkan regulasi lain yang menyatakan pemegang KK dapat diperpanjang masa operasinya menjadi IUPK tanpa melalui lelang. Hal ini merujuk pada Peraturan Pemerintah Nomor 77 Tahun 2014 tentang Pelaksanaan Kegiatan Pertambangan Mineral dan Batubara. Pada pasal 112B disebutkan IUPK diberikan oleh Menteri ESDM setelah wilayahnya ditetapkan menjadi WIUPK Operasi Produksi oleh Menteri. Hanya ketentuan penetapan WIUPK itu dihapus dalam naskah revisi Peraturan Pemerintah (PP) nomor 77 tahun 2014. Namun hingga kini revisi PP 77/2014 tidak segera keluar.
“jadi terkait perubahan KK menjadi WIUPK itu adanya di Peraturan Pemerintah (PP) nomor yahun 2010 dan Peraturan Pemerintah (PP) ini belum direvisi,” ujarnya.
