The Mimika Regency Government immediately formed a regional-owned enterprise (BUMD) to manage the shares of PT Freeport Indonesia, regardless of the BUMD owned by the Papua Provincial Government. This is because the Mimika Regency Government does not agree to share distribution decided by the Provincial Government.
Mimika Regent Eltinus Omaleng said, the establishment of BUMD which would manage PT Freeport Indonesia's shares was driven by unilateral decisions of the Provincial Government and the Regional Representatives Council (DPRD) of the Papua Province through Regional Regulation Number 7 Year 2018 concerning Papua Limited Liability Company Divesting Mandiri.
Article 15 regulates the composition of shares in the company, namely the Provincial Government of Papua, 51%, Mimika Regency Government 29%, and District Government around the Freeport operating area 20%.
In fact, the composition of Papuan shares from 51% of the Indonesian Government's shares in Freeport has been arranged in accordance with a joint agreement between the Government of Indonesia, the Governor of Papua, and the Regent of Mimika. Papua shares are set at 10%, consisting of 7% for Mimika including indigenous peoples and 3% for the Papua Provincial Government.
"We certainly protested strongly against the decision of the Governor and the Papua DPRD to determine the composition of the shares of 10%. We don't approve it and will form our own BUMD, "Omaleng said.
The Mimika Regency Government together with the local DPRD, he said, immediately convened to determine the Regional Regulation for the establishment of the BUMD in question.
"I have already told the Chairperson of the DPRD (Chairperson of the Mimika DPRD Elminus B Mom). The name of the BUMD already exists, we will submit it to the Mimika DPRD to be determined. We will do this as soon as possible, "explained Omaleng.
Some time ago, Mimika Regent Eltinus Omaleng sent a letter to President Joko Widodo in Jakarta with a copy to the Indonesian Minister of Finance, Minister of Energy and Mineral Resources, and Managing Director of PT Inalum. In the manuscript, the Regent of Omaleng wanted no change in the share to the Mimika Regency Government which was 7% and the Papua Provincial Government 3% of the 10% share of Freeport's shares for Papua.
The letter was in response to the wishes of Papua Governor Lukas Enembe who wanted a share of 51% of the 10% share of Freeport shares received by Papua.
Settlement of these problems has been sought through facilitation / mediation by the Ministry of Finance Republic of Indonesia on December 14, 2018 and the Ministry of Home Affairs of the Republic of Indonesia on January 11, 2019. However, to date, the Papua Provincial Government has not followed up on changes in the composition of shares in Article 15 of Regional Regulation No. 7 of 2018.
On the other hand, the settlement of the acquisition of PTFI's divested shares was completed by Inalum on December 21, 2018. While the establishment of BUMD is still problematic. For this reason, as much as 10% of Papua's shares are currently taken over and managed by Inalum.

Kabupaten Mimika segera Bentuk BUMN PengeIoIa Saham Freeport
Pemerintah Kabupaten Mimika segera membentuk badan usaha milik daerah (BUMD) untuk mengelola saham PT Freeport Indonesia, terlepas dari BUMD milik Pemerintah Provinsi Papua. Hal ini lantaran Pemerintah Kabupaten Mimika tidak sepakat pembagian saham yang diputuskan Pemerintah Provinsi.
Bupati Mimika Eltinus Omaleng mengatakan, pembentukan BUMD yang akan mengelola saham PT Freeport Indonesia tersebut didorong oleh keputusan sepihak Pemerinah Provinsi dan Dewan Perwakilan Rakyat Daerah (DPRD) Provinsi Papua melalui Peraturan daerah Nomor 7 Tahun 2018 tentang Perseroan Terbatas Papua Divestasi Mandiri.
Pasal 15 beleid itu mengatur komposisi saham dalam perusahaan yaitu Pemerinah Provinsi Papua sebesar 51%, Pemerintah Kabupaten Mimika 29%, dan Pemerinah Kabupaten di sekitar area operasi Freeport 20%.
Padahal, komposisi saham Papua dari 51% saham Pemerintah Indonesia di Freeport sudah diatur sesuai kesepakatan bersama antara Pemerintah Indonesia, Gubernur Papua, dan Bupati Mimika. Saham Papua ditetapkan 10% yang terdiri atas 7% untuk Mimika termasuk masyarakat adat dan 3% untuk Pemerinah Provinsi Papua.
“Kami tentu protes keras pada keputusan Gubernur dan DPRD Papua yang menentukan sendiri komposisi saham dari 10% itu. Kami tidak menyetujuinya dan akan membentuk BUMD sendiri,” kata Omaleng.
Pemerintah Kabupaten Mimika bersama DPRD setempat, katanya, segera bersidang untuk menetapkan Peraturan Daerah pembentukan BUMD dimaksud.
“Saya sudah sampaikan pada Ketua DPRD (Ketua DPRD Mimika Elminus B Mom). Nama BUMD-nya sudah ada, kami akan ajukan ke DPRD Mimika untuk ditetapkan. Ini akan kami lakukan secepatnya,” jelas Omaleng.
Beberapa waktu lalu, Bupati Mimika Eltinus Omaleng telah mengirim surat kepada Presiden Joko Widodo di Jakarta dengan copy kepada Menteri Keuangan RI, Menteri ESDM, dan Dirut PT Inalum. Dalam surainya itu, Bupati Omaleng menginginkan tidak ada perubahan bagian saham ke Pemerintah Kabupaten Mimika yakni 7% dan Pemerintah Propinsi Papua 3% dari 10% jatah saham Freeport untuk Papua.
Surat tersebut sebagai respon atas keinginan Gubernur Papua Lukas Enembe yang menginginkan jatah saham 51% dari 10% jatah saham Freeport yang diterima Papua.
Penyelesaian terhadap permasalahan tersebut telah diupayakan melalui fasilitasi/mediasi oleh Kementerian Keuangan Republik Indonesia (RI) pada 14 Desember 2018 dan Kementerian Dalam Negeri RI pada 11 Januari 2019. Namun hingga saat ini, Pemerintah Propinsi Papua belum menindaklanjuti perubahan tentang komposisi saham sebagaimana yang ada dalam Pasal 15 Perda Nomor 7 tahun 2018.
Di sisi lain, penyelesaian terhadap pengambilalihan saham divestasi PTFI telah selesai dilakukan oleh Inalum pada 21 Desember 2018 lalu. Sedangkan pembentukan BUMD hingga saat ini masih bermasalah. Untuk itu, sebanyak 10% saham Papua sementara ini diambil alih dan dikelola oleh Inalum.
