2015 Saja, Seharusnya Bayar Pajak Denda Rp 5 Triliun
Pemerintah dalam hal ini Direktorat Jenderal Pajak (DJP) Kementerian Keuangan telah memasang angka settlement (penyelesaian ‘damai’) dalam memajaki Google Asia Pte Ltd. Namun, angka damai tersebut ditolak oleh Google karena dianggap terlalu tinggi. Google meminta angka yang lebih rendah dari pada angka settlement. Maka dipastikan Google tidak akan membayarkan tunggakan pajaknya tahun ini.
Kepala Kantor Wilayah DKI Jakarta Khusus DJP Muhammad Haniv mengatakan, pihaknya memasang angka settlement dengan hitungan yang matang dan sudah merupakan angka nominal dari yang seharusnya dibayarkan perusahaan berbasis internet tersebut sepanjang 2015. “Saya pasang satu angka, angka damai lah dan dia nawar di angka yang bawah sekali. Dia minta saya turun dan dia naik, tidak bisa saya bilang. Ini angka saya yang konservatif,” kata Haniv, di kantor pusat DJP, Jakarta Selatan, Selasa (20/12).
Dirinya tak mau menyebutkan angka pasti yang ditetapkan. Namun, jika diibaratkan antara settlement DJP dan keinginan Google antara 10 berbanding dua atau satu per lima dari angka settlement atau sekitar Rp 1 Triliun. Haniv menjelaskan, pemilihan angka damai ini tentunya berdasarkan melihat penerapan di berbagai dunia, seperti di London dan India yang menentukan angka damai. Dirinya mengatakan kasus pajak Google ini merupakan modus baru yang memang belum ada aturan pajaknya di dunia sehingga mereka bisa sangat fleksibel untuk negosiasi. “Semua mengarah ke angka damai, ya sudah kita ikud tren dunia untuk masalah Google ini, karena Google modus baru,” ujar dia.
Proses Settlement Ditutup.
Dengan ditolaknya pajak angka damai dari pemerintah, kini DJP menyatakan proses settlement atau penyelesaian dengan negosiasi mengenai kewajiban pajak dengan Google Asia Pte Ltd yang berkantor di Singapura ditutup. Haniv mengatakan, pihaknya akan melanjutkan pemeriksaan biasa. Artinya kesempatan DJP memberikan tarif ‘damai’ bagi Google tak berlaku lagi. Haniv menjelaskan, Google tahun depan harus membuka pembukuan atau memberikan data seluruh transaksi di Indonesia dalam bentuk file elektronik.
Dia bilang data tersebut harus diberikan pada Januari. Artinya perlakuan akan kembali normal dan Google bakal dikenakan denda 150 persen dari pokok pajaknya, yang mana denda plus pokok pajak untuk 2015 saja diperkirakan RP 5 Triliun.
“Tahun depan bukan settlement lagi. Settlement saya tutup. Kita lanjutkan pemeriksaan biasa, bukti permulaan. Google tahun depan berikan datanya, saya hitung pajaknya, dan ingat konsekuensinya denda 150 persen,” papar Haniv.
Terancam Denda 400%
Dia mengatakan, jika bulan Januari Google masih juga tak memberikan data yang diminta, maka DJP tak segan untuk melakukan investigasi secara menyeluruh (full investigation) yang berarti akan dikenakan denda lebih besar lagi, yakni 400 persen yang diatur dalam Undang-Undang KUP, Lagi pula, menurut Haniv; perusahaan sekelas Google sebagai pusat data yang dibutuhkan banyak orang dan menyajikannya dalam hitungan detik, tak semestinya perlu waktu panjang untuk menampilkan data yang diminta Ditjen Pajak. Haniv menjelaskan, full investigasi dilakukan apabila tidak ada niat baik dari Google dalam bekerjasama dengan otoritas
pajak untuk keperluan pemeriksaan.
