Until now, the licensing status of PT Freeport Indonesia (Freeport) is still blurred. The government has not issued a definitive Special Mining Business Permit (SMBP/IUPK). This means the Freeport tax treatment has not changed. On the other hand, the company's copper concentrate export activities continue to swing. Director General of Mineral and Coal (Minerba) of the Ministry of Energy and Mineral Resources (ESDM) Bambang Gatot Ariyono reasoned that all licensing processes towards definitive IUPK issuance were still being evaluated.
"We will see it later, everything is being evaluated," he said when met at the ESDM Ministry Office, Monday (10/22).
Previously, Bambang said that the status of the IUPK which was still temporary could not be separated from the process of divesting 51% of Freeport's shares by PT Inalum which had not yet been completed. According to him, after the divestment process is declared over, the government can issue IUPK for 2 X 10 years after the contract expires in 2021.
However, the IUPK with a period of 2 x 10 years does not mean that it is immediately given until 2041. So that the IUPK is only up to 2031, because each period has requirements that must be met.
"Each one is in a conditional, there are requirements. So until 2031 it will be given immediately, but for the 2041, as long as they (Freeport Indonesia) meet the requirements, yes it can," explained Bambang.
While the Director of Mineral and Mineral Resources Development of the Ministry of Energy and Mineral Resources Ministry, Bambang Susigit added, the divestment must first be completed so that the definitive IUPK can be issued.
"It has been repeatedly explained, there are four issues and one of them is the divestment that must be completed, only the definitive TUPK will be published. Never and will not be reversed," he said.
The four issues in question are the extension of operating licenses, the stability of investment, the construction of smelters and the obligation to divest 51% of the shares.

Hingga kini status perizinan PT Freeport Indonesia (Freeport) masih buram. Pemerintah belum menerbitkan Izin Usaha Pertambangan Khusus (IUPK) definitif. lni berarti perlakuan pajak Freeport belum berubah. Di sisi lain, kegiatan ekspor konsentrat tembaga perusahaan ini masih terus melenggang. Direktur Jenderal Mineral dan Batubara (Minerba) Kementerian Energi dan Sumber Daya Mineral (ESDM) Bambang Gatot Ariyono beralasan, semua proses perizinan menuju penerbitan IUPK definitif masih dievaluasi.
"Ya nanti kami lihat, sedang dievaluasi semuanya" kata dia saat ditemui di Kantor Kementerian ESDM, Senin (22/10).
Sebelumnya, Bambang bilang, status IUPK yang masih sementara itu tidak terlepas dari proses divestasi 51% saham Freeport oleh PT lnalum yang belum rampung. Menurut dia, setelah proses divestasi dinyatakan usai, pemerintah bisa mengeluarkan IUPK selama 2 X 10 tahun setelah habis masa kontrak pada tahun 2021 mendatang.
Namun IUPK dengan masa 2 X 10 tahun itu tidak berarti langsung diberikan hingga tahun 2041. Sehingga IUPK hanya sampai tahun 2031, itu lantaran masing-masing periode memiliki persyaratan yang harus dipenuhi.
"Masing-masing dalam conditional, ada persyaratannya. Jadi sampai 2031 langsung diberikan, tapi yang 2041 nanti, sepanjang mereka (Freeport Indonesia) memenuhi persyaratan, ya bisa," jelas Bambang.
Sementara Direktur Pembinaan Pengusahaan Mineral Dirjen Minerba Kementerian ESDM, Bambang Susigit menambahkan, divestasi harus terlebih dulu diselesaikan agar IUPK definitif bisa terbit.
"Sudah loerulang-ulang dijelaskan, ada empat isu dan salah satunya divestasi yang harus selesai, baru TUPK definitif terbit. Tidak pernah dan tidak akan terbalik," katanya.
Empat isu yang dimaksud ialah perpanjangan izin operasi, stabilitas investasi, pembangunan smelter dan kewajiban divestasi 51% saham.
